FINANCIAL GUARANTY INSURANCE COMPANY V. THE PUTNAM ADVISORY COMPANY, LLC

After a three and a half week virtual bench trial via Zoom, the judge held for the defense on all counts, finding that the Financial Guaranty Insurance Company (FGIC) had failed to prove any of its claims that Putnam had committed fraud, negligent misrepresentation, and negligence in its capacity as the collateral manager of the complex collateralized debt obligation, Pyxis. After a ten-day bench trial, the court found in favor of the defense on all key issues related to the claims brought by the creator and executive producers of The Walking Dead that AMC exploited their vertically integrated corporate structure to reduce the contingent compensation owed to the show’s profit participants. After a two-week bench trial, the United States District Court denied an injunction sought by 13 states and the District of Columbia, clearing the way for the $26.5 billion merger of T-Mobile US, Inc. and Sprint Corp., the nation’s third and fourth largest mobile carriers. After a two-week trial and just 60 minutes of deliberation, the Boston jury delivered a complete defense verdict, rejecting Plaintiffs’ claims for negligent and intentional misrepresentation. Plaintiffs alleged that the Defendant’s marketing materials falsely described the capabilities of their heating and air conditioning system. Defendant was an employee at Green Mountain Coffee Roasters accused of insider trading. After a nearly two-week trial and four days of deliberations, the Vermont jury found in favor of the defense. DRC assisted the defense team at Finn Dixon & Herling with a focus group, demonstrative aids, jury selection, and technical support during the trial.

DRC assisted Quinn Emanuel with focus groups, trial strategy, jury selection, and demonstrative aids in this residential mortgage-backed securities case. After a three week trial, the jury returned a Plaintiffs’ verdict of $28.7M in favor of DRC’s client.

STATE OF FLORIDA V. CLEMENTE AGUIRRE-JARQUIN
(Seminole County Circuit Court)

In 2016, the Florida Supreme Court unanimously overturned Aguirre’s 2006 conviction and death sentence based on new evidence. Florida decided to retry Aguirre and seek the death penalty a second time. In 2018, Aguirre was freed after prosecutors announced, in the middle of jury selection, that they would not proceed with a retrial, based on exculpatory evidence developed by Aguirre’s legal team. DRC assisted Aguirre's retrial team with trial strategy, jury selection, and demonstrative aids. Josh Dubin acted as one of the lead trial lawyers, and both DRC and Josh Dubin provided services pro-bono.

RAINBOW V. ECHOSTAR

Breach of contract case involving AMC Networks and the DISH Network. Just prior to summation, DRC client Gibson Dunn negotiated a landslide settlement. DRC’s pre-trial feedback, jury selection advice, witness preparation, and demonstrative aids assisted in the resounding victory.

IN RE: TYCO SECURITIES FRAUD LITIGATION

Worked with the lead plaintiff's counsel on securities class action against Tyco International, Ltd. involving acquisition accounting fraud and looting of the company's assets by its former officers and directors. DRC was retained to provide trial strategy consulting and demonstrative aids. The case resulted in a multi-billion dollar settlement on behalf of the plaintiffs.

RESTIVO & HALSTEAD V. NASSAU COUNTY

DRC assisted Neufeld, Scheck & Brustin secure a $36 million verdict for John Restivo and Dennis Halstead, who spent eighteen years in prison for a 1984 rape and murder before DNA testing proved their innocence. At the time, the verdict was the biggest jury award ever achieved in a wrongful conviction case. DRC conducted focus groups, assisted with jury selection, trial strategy, prepped key witnesses, and created demonstrative aids.

NEW JERSEY V. DHARUN RAVI
(Superior Court, New Jersey)

Case involving the Rutgers student accused of invasion of privacy for allegedly watching his roommate in an intimate moment via web-cam. The case garnered international media attention. DRC was retained by defense counsel to assist with jury selection, trial strategy, and demonstratives.

IN RE: EBOOKS ANTITRUST LITIGATION

DRC was retained by Apple after the DOJ claimed there was a conspiracy involving Apple and the Settling Publishers to fix and raise retail prices of E-books. DRC conducted a mock bench trial, provided trial strategy consulting, and created demonstrative aids.

FLORIDA V. JOHN GOODMAN
(Palm Beach County Circuit Court)

Founder of International Polo Club of Palm Beach accused of vehicular manslaughter. DRC was retained by defense counsel to assist with jury selection, trial strategy, and demonstratives. The conviction was set aside and a new trial ordered after DRC helped uncover juror misconduct.

U.S. V. IRVING AND CHRISTOPHER LORENZO
(EDNY – THE "MURDER INC." CASE)

DRC was retained by Jerry Shargel and Jerry Lefcourt, who represented brothers Irving and Christopher "Gotti" Lorenzo. The Lorenzos were accused of laundering money for an alleged drug dealer. Both brothers were acquitted of all charges after a jury trial. DRC assisted with jury selection, trial strategy, and demonstratives.

WICHANSKY V. ZOWINE

Breach of fiduciary duty case in which plaintiff claimed he was ousted from the company he founded after uncovering medical billing fraud. DRC was retained to conduct focus groups, provide trial strategy consulting, witness prep, and demonstrative aids. After a jury trial, the jury awarded our client $27.6 million.

GIBBS V. CITY OF NEW YORK
(SDNY)

DRC was retained on behalf of Barry Gibbs, a former Brooklyn postman who spent almost 19 years in prison after being framed by "Mafia Cop" Louis Eppolito before a federal reinvestigation led to his exoneration by the Innocence Project. The case resulted in the largest settlement ever paid to an individual plaintiff by the City of New York.

NEW YORK V. KERRY KENNEDY
(N.Y. Crim. Ct., Westchester County)

Kerry Kennedy, daughter of Senator Robert F. Kennedy, was charged with DUI after a car accident. DRC assisted with jury selection, trial strategy, and demonstrative aids. Ms. Kennedy was acquitted of all charges.

Case involving prominent oil tycoon Oscar Wyatt, who was accused of violating the UN's Oil for Food Program. DRC assisted with jury selection, focus groups, trial strategy, and demonstrative aids.

MAYES V. CITY OF HAMMOND

DRC was retained on behalf of Larry Mayes, who spent more than 18 years in prison as a result of intentional and systemic misconduct by Hammond, Indiana police officers before DNA testing led to his exoneration by the Innocence Project. Resulted in a jury verdict on behalf of Mr. Mayes against the Captain of Detectives and the City of Hammond. DRC assisted with jury selection, trial strategy, and demonstratives.

DRC was retained on behalf of World Heavyweight Boxing Champion Lennox Lewis in a breach of fiduciary duty and accounting fraud case against his former promoter. The jury rendered a verdict in favor of Mr. Lewis. DRC assisted with jury selection, trial strategy, and demonstratives.

DRC worked with Gibson Dunn to secure a defense verdict after a one-hour jury deliberation in this federal class action case. The defense was able to successfully show that International Paper Company was not responsible for a dam breach that caused damage to the class area.
